AI ODV files legal complaint following the seizure of their server

The association behind the former Italian provider A/I, AI ODV, has lodged a complaint with the Amsterdam District Court against the seizure of its server by the Dutch police. A hearing on this matter will take place at the Amsterdam District Court on 9 December 2026. Affected individuals who suspect that their data is also stored on this server may submit their own complaint by 31 October.

It was previously reported that an A/I server had been seized by the Amsterdam police. In an earlier post, we explained why we consider it important to report on this matter. In this post, we provide an update on the issue.

AI ODV has now filed a complaint with the Amsterdam District Court, as it has been unable to defend itself against the sanctions imposed by the US. It also believes that the handover of the entire server is disproportionate, and points to a chilling effect on freedom of expression. AI ODV is asking the Amsterdam District Court to declare this seizure unlawful. It is also requesting that the use of the server be restricted by destroying the copy that was made. A hearing on this matter will take place at the Amsterdam District Court on 9 December 2026.

Other affected parties who suspect that their data was stored on the server may also lodge a complaint against the seizure themselves. This can be done before 31 October by sending their complaint to:

Amsterdam District Court, Public Law Division, Criminal Law Team
PO Box 84500
1080 BN Amsterdam
